The map was a key part of Democrats&#8217; effort to counter the Republican redistricting wave set off by President Trump.<\/p>\n<p>The new map was drawn by Democrats and approved by Virginia voters in <a href=\"https:\/\/www.elections.virginia.gov\/media\/electionadministration\/electionlaw\/4-21-2026-Special-Election-Explanation--Text.pdf\" target=\"_blank\"><u>an April referendum<\/u><\/a>. But on May 8, the Supreme Court of Virginia <a href=\"https:\/\/www.npr.org\/2026\/05\/08\/nx-s1-5805193\/redistricting-virginia-trump-midterms\" target=\"_blank\"><u>in a 4-to-3 vote<\/u><\/a> declared the referendum, and by extension the new map, <a href=\"https:\/\/www.vacourts.gov\/static\/opinions\/opnscvwp\/1260127.pdf\" target=\"_blank\"><u>null and void<\/u><\/a> because lawmakers failed to follow the proper procedures to get the issue on the ballot, violating the state constitution.<\/p>\n<p>Virginia Democrats and the state&#8217;s attorney general then appealed to the U.S. Supreme Court, seeking to put into effect the map approved by the voters, which yields four more likely Democratic congressional seats. In their <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1240\/408563\/20260511151941216_25A%20Application%20for%20Stay.pdf\" target=\"_blank\"><u>emergency application<\/u><\/a>, they argued the Virginia Supreme Court was &#8220;deeply mistaken&#8221; in its decision on &#8220;critical issues of federal law with profound practical importance to the Nation.&#8221; Further, they asserted the decision &#8220;overrode the will of the people&#8221; by ordering Virginia to &#8220;conduct its election with the congressional districts that the people rejected.&#8221;<\/p>\n<p><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A1240\/408888\/20260514160845177_Scott%20v%20McDougle%20Plaintiffs%20Opposition%20to%20Stay%20Application.pdf\" target=\"_blank\"><u>Republican legislators countered<\/u><\/a> that it would be improper for the U.S. Supreme Court to wade into a purely state law controversy \u2014 especially since the Democrats had not raised any federal claims in the lower court.<\/p>\n<p>Ultimately, the U.S. Supreme Court sided with Republicans without explanation leaving in place the state court ruling that voided the Democratic-friendly maps.<\/p>\n<p>The court&#8217;s decision not to intervene was its latest in emergency requests for intervention on redistricting issues. In December, the high court OK&#8217;d <a href=\"https:\/\/www.npr.org\/2025\/12\/04\/nx-s1-5619692\/supreme-court-texas-redistricting-map\" target=\"_blank\"><u>Texas<\/u><\/a> using a gerrymandered map that could help the GOP win five more seats in the U.S. House. In February, the court <a href=\"https:\/\/www.npr.org\/2026\/02\/04\/nx-s1-5691890\/supreme-court-california-redistricting-map\" target=\"_blank\"><u>allowed California<\/u><\/a> to use a voter-approved, Democratic-friendly map, adopted to offset Texas&#8217;s map. Then in March, the U.S. Supreme Court <a href=\"https:\/\/www.npr.org\/2026\/03\/02\/g-s1-112253\/supreme-court-new-york-redistricting\" target=\"_blank\"><u>blocked the redrawing<\/u><\/a> of a New York map expected to flip a Republican congressional district Democratic.<\/p>\n<p>And perhaps most importantly, in April, the <a href=\"https:\/\/www.npr.org\/2026\/04\/29\/nx-s1-5754657\/supreme-court-louisiana-redistricting\" target=\"_blank\"><u>high court ruled<\/u><\/a> that a Louisiana congressional map was a racial gerrymander and must be redrawn.
