But as prediction markets have surged \u2013 allowing users to bet on almost anything, from elections to sports to geopolitical events \u2013 the state has not escaped the nationwide boom.<\/p>\n<p class=\"dcr-130mj7b\">Its Republican leaders are fighting back, setting up a battle between one of the country\u2019s most conservative states and a rapidly growing industry that is embraced by a Republican administration in Washington \u2013 and members of the US president\u2019s own family.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt\u2019s a unique issue,\u201d Brady Brammer, a Republican state senator in Utah, said. \u201cBecause you have a lot of very conservative <a href=\"https:\/\/www.theguardian.com\/us-news\/republicans\" data-link-name=\"in body link\">Republicans<\/a> [in Utah] who are standing up to a conservative administration, essentially without dissent among them.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Prediction markets such as Kalshi \u2013 recently valued at <a href=\"https:\/\/www.nytimes.com\/2026\/05\/07\/business\/dealbook\/kalshi-fundraise-22-billion.html\" data-link-name=\"in body link\">$22bn<\/a> \u2013 and Polymarket allow users to \u201ctrade\u201d on events from Oscar picks to election outcomes, and have surged in popularity in recent years.<\/p>\n<figure id=\"a25922d1-e215-4a15-986a-44176965cc8d\" data-spacefinder-role=\"richLink\" data-spacefinder-type=\"model.dotcomrendering.pageElements.RichLinkBlockElement\" class=\"dcr-47fhrn\">\n<div data-print-layout=\"hide\" data-link-name=\"rich-link-4 | 4\" data-component=\"rich-link\" data-name=\"placeholder\" class=\"dcr-1kyw41h\">\n<div data-format-theme=\"5\" data-format-design=\"0\" data-format-display=\"0\" class=\"dcr-1bg5532\"><a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/apr\/24\/gambling-addiction-out-of-control-betting-markets\" class=\"dcr-1m887w9\"><\/p>\n<div class=\"dcr-ut4tvs\">\n<div class=\"dcr-1h5b6rb\">\n<div class=\"dcr-169d7yv\">US gambling addiction is \u2018out of control\u2019 as betting markets boom, policy expert warns<\/div>\n<\/div>\n<div class=\"dcr-eurq8n\">\n<div class=\"dcr-fkf7vq\">Read more<\/div>\n<\/div>\n<\/div>\n<p><\/a><\/div>\n<\/div>\n<\/figure>\n<p class=\"dcr-130mj7b\">The platforms have long contended that they do not facilitate gambling \u2013 an argument they have used to bypass the conventional regulatory landscape for gambling firms \u2013 and they operate almost nationwide.<\/p>\n<p class=\"dcr-130mj7b\">With the backing of federal regulators under Donald Trump, they classify their products as financial exchanges, governed by federal commodities law, rather than state gambling rules.<\/p>\n<p class=\"dcr-130mj7b\">Unlike casinos or traditional sports books, which set the odds on customers\u2019 bets, prediction market users \u201ctrade\u201d against one another while the platforms collect transaction fees. A Kalshi spokesperson said the platform \u201coperates like any other derivative market\u201d.<\/p>\n<p class=\"dcr-130mj7b\">But around the country, an increasing number of state officials are taking a different view. <a href=\"https:\/\/www.theguardian.com\/world\/prediction-markets\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Prediction markets<\/a> are simply gambling by another name, they argue, and an encroachment on state authority.<\/p>\n<p class=\"dcr-130mj7b\">So far, roughly 20 federal lawsuits have been filed nationwide over the platforms, with <a href=\"https:\/\/www.reuters.com\/world\/us\/nevada-judge-extends-ban-kalshi-operating-prediction-market-state-2026-04-03\/\" data-link-name=\"in body link\">early<\/a> rulings <a href=\"https:\/\/www.cnbc.com\/2026\/04\/07\/new-jersey-cannot-regulate-kalshis-prediction-market-us-appeals-court-rules.html\" data-link-name=\"in body link\">seeing <\/a>split <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/us-judge-blocks-tennessee-barring-kalshis-sports-events-contracts-2026-01-13\/\" data-link-name=\"in body link\">results<\/a>. Among the most outspoken opponents of these platforms are Republican lawmakers in Utah, a key battleground in this escalating engagement.<\/p>\n<hr class=\"dcr-z9ge1j\">\n<p class=\"dcr-130mj7b\">Spencer Cox, the Republican governor of Utah, has no time for the industry\u2019s arguments. Prediction markets are \u201cgambling \u2013 pure and simple\u201d, he <a href=\"https:\/\/x.com\/GovCox\/status\/2023795059980988874?s=20\" data-link-name=\"in body link\">declared<\/a> in February, and have \u201cno place in Utah\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Before Trump\u2019s return to power in January 2025, the federal government appeared equally concerned about some of the platforms\u2019 offerings.<\/p>\n<p class=\"dcr-130mj7b\">Under then president Joe Biden, the Commodity Futures Trading Commission (CFTC), the government agency that regulates the US derivatives markets and oversees prediction markets, sought to impose restrictions on the platforms and <a href=\"https:\/\/www.npr.org\/2025\/12\/23\/nx-s1-5647749\/rise-of-prediction-markets\" data-link-name=\"in body link\">ban<\/a> certain <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/8780-23\" data-link-name=\"in body link\">event<\/a> contracts <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/06\/10\/2024-12125\/event-contracts\" data-link-name=\"in body link\">tied to elections<\/a>, politics and sports. The FBI <a href=\"https:\/\/www.theguardian.com\/technology\/2024\/nov\/13\/fbi-raid-polymarket-founder-trump-election\" data-link-name=\"in body link\">raided the home<\/a> of Polymarket\u2019s founder in November 2024, as the site faced scrutiny.<\/p>\n<p class=\"dcr-130mj7b\">Under Trump, however, the CFTC has <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/12\/prediction-markets-polymarket-kalshi-online-gambling\" data-link-name=\"in body link\">reversed course<\/a>, defended its jurisdiction over the sector and curtailed the Biden-era crackdown.<\/p>\n<p class=\"dcr-130mj7b\">At the same time, the president\u2019s eldest son, Donald Trump Jr, <a href=\"https:\/\/news.kalshi.com\/p\/donald-trump-jr-strategic-advisor\" data-link-name=\"in body link\">serves as an adviser<\/a> to <a href=\"https:\/\/www.prnewswire.com\/news-releases\/polymarket-receives-strategic-investment-from-1789-capital-and-welcomes-donald-trump-jr-to-advisory-board-302538997.html\" data-link-name=\"in body link\">both<\/a> Kalshi and Polymarket. The president\u2019s own company the Trump Media and Technology Group, which operates his Truth Social platform, has also explored launching its own <a href=\"https:\/\/www.nytimes.com\/2026\/01\/15\/us\/politics\/donald-trump-jr-prediction-markets.html\" data-link-name=\"in body link\">prediction market<\/a> product.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe have a president who operates casinos,\u201d said Brammer, the state senator, referring to Trump\u2019s <a href=\"https:\/\/www.nytimes.com\/2026\/04\/24\/us\/politics\/trump-prediction-markets.html\" data-link-name=\"in body link\">past<\/a> ownership of casinos. \u201cHe clearly has no problem with gambling, and so it\u2019s not overly surprising that his agency heads, particularly in this space, are much more gamble-friendly than they previously have been, but Utah is not.\u201d<\/p>\n<figure id=\"ace3928f-4408-4560-a55c-5ac9efb8244f\" data-spacefinder-role=\"inline\" data-spacefinder-type=\"model.dotcomrendering.pageElements.ImageBlockElement\" class=\"dcr-173mewl\">\n<div id=\"img-2\" class=\"dcr-1t8m8f2\"><img decoding=\"async\" alt=\"A man in a legislative chamber.\" src=\"https:\/\/i.guim.co.uk\/img\/media\/79960048c6e442297f48ee48398272d4fee2d0e2\/0_0_5472_3648\/master\/5472.jpg?width=445&amp;dpr=1&amp;s=none&amp;crop=none\" width=\"445\" height=\"296.66666666666663\" loading=\"lazy\" class=\"dcr-evn1e9\"><a href=\"#img-2\" data-ignore=\"global-link-styling\" class=\"open-lightbox dcr-13fd1ms\" aria-hidden=\"true\"><button data-element-id=\"ace3928f-4408-4560-a55c-5ac9efb8244f\" type=\"button\" class=\"open-lightbox dcr-4tmywn\" aria-haspopup=\"dialog\"><span class=\"dcr-194i6pr\">View image in fullscreen<\/span><\/button><\/a><\/div><figcaption data-spacefinder-role=\"inline\" class=\"dcr-fd61eq\"><span class=\"dcr-1inf02i\"><\/span><span class=\"dcr-1qvd3m6\">Brady Brammer in 2021.<\/span> Photograph: Utah Reps<\/figcaption><\/figure>\n<p class=\"dcr-130mj7b\">Brammer and his colleagues are prepared to push back. \u201cIt doesn\u2019t matter whether it\u2019s Trump, or Biden or whatever administration it is, we\u2019re going to stand up for what we believe needs to happen in Utah,\u201d he said.<\/p>\n<p class=\"dcr-130mj7b\">After the CFTC <a href=\"https:\/\/x.com\/ChairmanSelig\/status\/2023744651216240966?s=20\" data-link-name=\"in body link\">said<\/a> in February that it was filing a friend-of-the-court brief defending its \u201cexclusive jurisdiction\u201d over the platforms, Cox <a href=\"https:\/\/x.com\/GovCox\/status\/2023795059980988874?s=20\" data-link-name=\"in body link\">vowed<\/a> that he would use \u201cevery resource within my disposal as governor\u201d to challenge them in court.<\/p>\n<p class=\"dcr-130mj7b\">Derek Brown, Utah\u2019s attorney general, has taken a similar stance,arguing that placing a \u201ctrade\u201d on these platforms is \u201csimply a bet, dressed up in different clothing\u201d. <a href=\"https:\/\/www.deseret.com\/opinion\/2026\/02\/22\/utah-gambling-apps-prediciton-markets-harmful-dangerous\/\" data-link-name=\"in body link\">In an opinion piece for the Deseret News<\/a>, Brown wrote: \u201cBetting. Wagering. Trading on futures. A wolf in sheep\u2019s clothing is still a wolf \u2026<\/p>\n<p class=\"dcr-130mj7b\">\u201cI was recently asked whether I plan to do anything about the rapid rise of prediction market apps that are now operating in Utah,\u201d he added. \u201cMy response? You can bet on it.\u201d<\/p>\n<hr class=\"dcr-z9ge1j\">\n<p class=\"dcr-130mj7b\"><span style=\"color:var(--drop-cap);font-weight:500\" class=\"dcr-15rw6c2\">T<\/span>he industry tried to get in first, taking the fight to court. In February, Kalshi sued Cox and Brown, alleging that Utah was preparing to block the company \u201cfrom offering event contracts for trading on its federally regulated exchange\u201d. The pair had \u201crepeatedly represented that they believe Kalshi is operating unlawfully under Utah anti-gambling laws\u201d, the company said.<\/p>\n<p class=\"dcr-130mj7b\">Kalshi, which is seeking an injunction against any such ban, contends that any move by Utah to prohibit it from operating in the state would interfere with federal regulations \u2013 specifically those legislated by Congress to oversee financial derivatives and their exchanges. The litigation remains ongoing.<\/p>\n<p class=\"dcr-130mj7b\">In a statement, a spokesperson for Kalshi said: \u201cWhether a state has gambling operations or whether they ban it is irrelevant to federal law, which says you can have nationwide exchange for event contracts.\u201d<\/p>\n<p class=\"dcr-130mj7b\">\u201cThis is for the CFTC to decide, not the states,\u201d it added. The CFTC and Polymarket did not respond to requests for comment from the Guardian.<\/p>\n<p class=\"dcr-130mj7b\">Kalshi recently secured a victory in Arizona, <a href=\"https:\/\/azmirror.com\/briefs\/arizonas-criminal-case-against-kalshi-permanently-blocked-by-federal-judge\/\" data-link-name=\"in body link\">where a federal judge<\/a> blocked the state from pursuing criminal charges tied to alleged violations of state gambling laws. But the company has faced setbacks in <a href=\"https:\/\/www.reuters.com\/world\/us\/nevada-judge-extends-ban-kalshi-operating-prediction-market-state-2026-04-03\/\" data-link-name=\"in body link\">Nevada<\/a> and <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/us-judge-blocks-tennessee-barring-kalshis-sports-events-contracts-2026-01-13\/\" data-link-name=\"in body link\">Tennessee<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWhen we look around the country, they win some, they lose some,\u201d John Holden, a business law professor at Indiana University who focuses on sports and gambling law, said of the prediction market platforms. \u201cA lot of people would look at a state like Utah and basically say, well, they don\u2019t have gambling, of course [Kalshi] is going to lose.<\/p>\n<p class=\"dcr-130mj7b\">\u201cBut the reality is, when the federal judges are looking at these cases, they\u2019re looking at, legally, is this something under the CFTC jurisdiction, in their view? And there\u2019s clearly a lot of dispute here, because we\u2019re getting these different court cases and decisions around the country.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The complex patchwork of rulings raises a larger question, according to Holden: will the US supreme court take on this question?<\/p>\n<hr class=\"dcr-z9ge1j\">\n<p class=\"dcr-130mj7b\">With Utah\u2019s legal battle ongoing, state lawmakers have moved to reinforce their position by amending the state constitution.<\/p>\n<p class=\"dcr-130mj7b\">In March, the GOP-controlled Utah state legislature expanded the state\u2019s legal definition of gambling in its ban to include <a href=\"https:\/\/le.utah.gov\/~2026\/bills\/static\/HB0243.html\" data-link-name=\"in body link\">\u201cproposition bets\u201d<\/a> \u2013 defined as \u201ca gambling bet on an individual action, statistic, occurrence or non-occurrence\u201d \u2013 in a bid to ensure prediction markets will be covered. A <a href=\"https:\/\/www.deseret.com\/utah\/2026\/03\/18\/march-madness-gambling-prediction-markets-ncaa-tournment-sports-betting\/\" data-link-name=\"in body link\">recent poll<\/a> found that 50% of adults in the state consider prediction markets to be gambling, while 30% do not.<\/p>\n<p class=\"dcr-130mj7b\">Brammer believes that lawmakers in Utah will \u201cfight to the bitter end, to the US supreme court, before we would acknowledge that it is appropriate to have prediction markets in Utah\u201d, he said. The legislation passed unanimously in the state senate.<\/p>\n<p class=\"dcr-130mj7b\">Democratic state senator Stephanie Pitcher, who also backed the measure, said she was concerned about the potential \u201cof insider trading and a type of either market manipulation or certain outcomes that could come forward\u201d on these platforms.<\/p>\n<p class=\"dcr-130mj7b\">Even Trump, when asked last month about concerns that federal employees might be using insider information on the prediction markets, claimed he was \u201c<a href=\"https:\/\/www.nytimes.com\/2026\/04\/24\/us\/politics\/trump-prediction-markets.html\" data-link-name=\"in body link\">never much in favor\u201d<\/a> of the practice.<\/p>\n<p class=\"dcr-130mj7b\">The companies say that they monitor for such risks. Earlier this year, Kalshi expanded its <a href=\"https:\/\/www.businesswire.com\/news\/home\/20260205980897\/en\/Kalshi-Announces-Independent-Surveillance-Audit-Committee-Partnerships-with-Director-of-Wharton-Forensic-Analytics-Lab-and-Solidus-Labs-and-new-Head-of-Enforcement\" data-link-name=\"in body link\">surveillance and enforcement efforts<\/a> to detect and remove accounts engaging in insider trading and market manipulation.<\/p>\n<hr class=\"dcr-z9ge1j\">\n<p class=\"dcr-130mj7b\"><span style=\"color:var(--drop-cap);font-weight:500\" class=\"dcr-15rw6c2\">P<\/span>itcher was not surprised Utah lawmakers have been so outspoken in their opposition. The state, along with Hawaii, remains one of the few <a href=\"https:\/\/www.deseret.com\/2012\/9\/1\/20433248\/utah-was-opposed-to-gambling-long-before-statehood\/\" data-link-name=\"in body link\">without any form of legalized gambling<\/a>, prohibiting everything from casinos to lotteries to sports betting.<\/p>\n<p class=\"dcr-130mj7b\">Utah is heavily influenced by the teachings of the Church of Jesus Christ of Latter-day Saints, which counts more than <a href=\"https:\/\/newsroom.churchofjesuschrist.org\/facts-and-statistics\/state\/utah\" data-link-name=\"in body link\">2 million members<\/a> in the state \u2013 over half its population. And the church \u201creally views gambling as a vice that leads to addiction, selfishness, destructive behaviors\u201d, Pitcher said. \u201cI think that is why you\u2019re seeing Utah maybe a slightly different position than other red states.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Patrick Mason, a professor of religious studies at Utah State University, added that Latter-day Saints are still \u201cfar the single biggest group in terms of powerbrokers in the state\u201d, adding: \u201cAll of the Utah congressional delegation are Latter-day Saints \u2013 the governor, lieutenant governor, the senate and the house leadership are all Latter-day Saints.\u201d<\/p>\n<p class=\"dcr-130mj7b\">For the church, Mason explained, gambling is seen \u201cas a moral issue\u201d and \u201cas a character issue\u201d that can be tied to harmful social effects.\u201cThe church has also always had a very strong emphasis on a work ethic, on independence, on self-reliance. And they see gambling as trying to get something for nothing.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Utah lawmakers are taking this fight to Washington, where the representative Blake Moore, a Republican from Utah, <a href=\"https:\/\/blakemoore.house.gov\/media\/press-releases\/representatives-moore-carbajal-introduce-bipartisan-bill-to-regulate-prediction-markets\" data-link-name=\"in body link\">introduced<\/a> the Event Contract Enforcement Act alongside representative Salud Carbajal, a Democrat from California, in March.
